Terms of Use
LiDify helps you measure a physical object and produce a 3D model of it. What you then make from that model is your responsibility, and some things you must not make from it at all. Section 8 is the part to read properly.
1. This agreement
These Terms are between you and Luther Brooks, an independent developer ("we", "us"), and govern your use of the LiDify app. By downloading or using LiDify you accept them. If you do not accept them, do not use the app.
Apple is not a party to these Terms. See section 17.
2. Who may use LiDify
You must be old enough to form a binding contract where you live, and able to accept these Terms on your own behalf or on behalf of an organisation you are authorised to bind.
3. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use LiDify on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service.
This licence is granted on the condition that you comply with section 8. Use of LiDify, or of anything it produces, outside that condition is outside the scope of this licence.
4. Subscription, free scans and trial
- LiDify includes a small number of free scans. A free scan is used when a scan first produces a model.
- A used scan is not returned to you by deleting the scan. The count only goes up.
- Beyond that allowance, continued scanning requires a subscription, offered monthly or yearly, and billed through your Apple Account.
- An introductory free trial may be offered. Its length and the price afterwards are shown in the app before you subscribe.
- Subscriptions renew automatically until cancelled. Cancel at least 24 hours before the period ends, in Settings on your device — not in LiDify, which cannot cancel anything.
- Refunds are handled by Apple, not by us. We cannot issue, approve or deny one.
- Anything you have already made stays available to you whether you subscribe or not.
5. What LiDify is, and is not
LiDify is a measurement and modelling aid for people who are comfortable checking their own work.
It is not a metrology instrument, not a CAD package, not an engineering service, not a substitute for professional judgement, and not certified to any standard by anyone.
6. Accuracy
LiDify builds models from photographs. Accuracy depends on the object, the lighting, your technique, the device and your calibration.
Any accuracy figure stated in the app or its documentation describes results we observed in our own testing under favourable conditions. It is not a specification, a tolerance, a warranty or a guarantee of the result you will get. Real results may be materially worse — particularly for small features, thin walls, threads, bores, and any surface the camera could not see.
A measurement you take yourself with a calliper is exact. A dimension taken off a scan is an estimate. Where they disagree, your calliper is right.
7. Your duty to verify
Before you fabricate, install, fit or rely on any part, you will independently verify every dimension on which fit, function or safety depends, by physically measuring the actual object with an appropriate instrument.
You will not rely on a dimension taken from a scan for any such purpose. This applies however confident the app appears, and whatever any AI feature suggests.
8. What you must not use LiDify for
You will not use LiDify, and will not use any model, measurement, dimension or file produced with it, to design, specify, fabricate, install, sell, supply or distribute any part for use in:
- Load-bearing or structural applications — anything supporting a person or a suspended load; rigging, lifting, hoisting, climbing, fall arrest, scaffolding, ladders, railings, jack stands, or furniture that carries a person
- Pressure-retaining applications — compressed gas or air, hydraulics, pneumatics, propane or LPG, diving or breathing apparatus, boilers, or pressurised plumbing
- Medical, dental or veterinary applications — implants, surgical guides, prosthetics or orthotics, anything contacting tissue or bodily fluid, and anything regulated as a medical device
- Vehicles, aircraft and watercraft — any part on a car, motorcycle, bicycle, aircraft, drone, boat or rail vehicle, and in particular braking, steering, suspension, fuel, restraint or flight-critical systems
- Electrical and thermal applications — mains-voltage enclosures, insulators, connectors, and holders or enclosures for lithium cells or battery packs
- Life safety and protective equipment — helmets, harnesses, respirators, eye protection, fire or emergency equipment
- Items for children, or food and drink contact — toys, infant products, anything intended for a child's mouth, and any food- or drink-contact surface
- Firearms, weapons, and regulated or export-controlled items
- Anything requiring certification to a standard or regulatory regime (for example CE, UKCA, UL, FDA, FAA or DOT), unless you independently qualify the part under that regime
- Any other application in which failure, inaccuracy or a dimensional error could result in injury, death, or significant property or environmental damage
This section applies regardless of anything in the app that might appear to suggest otherwise, including the output of any AI feature. Breach of this section terminates your licence and triggers section 15.
9. AI features
LiDify offers two ways to involve an AI assistant, both optional.
The first writes a folder of files that you share into whichever assistant you choose. Nothing is transmitted by the app.
The second sends a request to Anthropic using your own API key, after showing you exactly what will be sent and asking you to confirm. In that case you are the customer of Anthropic, their terms and privacy policy apply to you, and you are responsible for what they charge you. We have no account, no contract and no visibility in that exchange.
AI output is generated by a third-party model, is not reviewed by us, and may be confidently wrong. It is a suggestion to check, not an answer to trust. Section 7 and section 8 apply to it in full.
10. Your content is yours
Your scans, photographs, measurements and models belong to you. We claim no licence to them and hold no copy of them. They are on your device.
11. Other people's rights
You are responsible for having the right to scan what you scan and to make what you make. Do not use LiDify to copy or distribute an object you have no right to reproduce, or to produce anything whose manufacture, possession or export is restricted where you are.
12. Our rights
LiDify, its name and its code are ours and are licensed, not sold. You will not copy, redistribute, rent, sell, reverse engineer or attempt to derive the source code of the app, except where that restriction is prohibited by law.
13. Disclaimer of warranties
LIDIFY IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY MEASUREMENT, MODEL OR FILE IT PRODUCES WILL BE ACCURATE, COMPLETE, OR FIT FOR ANY PURPOSE.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary or punitive damages; nor for lost profits, lost revenue, business interruption, cost of substitute goods, wasted materials or machine time, or damage to or loss of any property, tooling, machinery, equipment or object arising from your use of LiDify or of anything produced with it.
Our total aggregate liability for all claims is limited to the greater of the amount you paid us for LiDify in the twelve months before the claim arose, or US $50.
What this section does not limit. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that cannot lawfully be excluded or limited.
15. Indemnity
You will indemnify and hold us harmless against any claim, loss, liability or expense (including reasonable legal fees) brought by a third party and arising from your use of LiDify, from anything you fabricate, install, supply or distribute using it, or from your breach of section 8 or section 11. This does not apply to the extent the claim arises from our own negligence or wilful misconduct.
16. Termination
This licence ends if you stop using LiDify and delete it, or if you breach these Terms. Sections 6, 7, 8 and 10 to 20 survive termination.
17. Apple
These Terms are between you and us only. Apple is not a party to them and is not responsible for LiDify or its content.
- Your licence to use LiDify is limited to non-transferable use on Apple-branded devices you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except that LiDify may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- We alone are responsible for LiDify and its content. Apple has no obligation to provide any maintenance or support for it.
- If LiDify fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to LiDify.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to LiDify, including product liability claims, any claim that it fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar law.
- We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that LiDify infringes that party's intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using LiDify.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right — and is deemed to have accepted the right — to enforce them against you.
- Questions, complaints and claims about LiDify should be directed to us at support@lidify.app.
18. Changes
We may update these Terms. The current version is always at this address, with its effective date at the top. Continuing to use LiDify after a change means you accept it. Material changes will be noted in the app's release notes.
19. Governing law, and your local rights
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules, and you and we submit to the courts located there.
If you are a consumer, this does not take away your local rights. Nothing in these Terms limits or excludes any right or remedy you have under the consumer protection law of your country of residence that cannot lawfully be limited or excluded, and you may be entitled to bring proceedings in your own country.
